Via Article 30 of the Public Procurement Code, the State had the good idea of defending innovative companies and avoiding wasting time for town halls and communities. avoiding “unnecessary” calls for tenders on unique or exclusive products. Therefore, Our bike racks benefit from article 30.I.3.C of the public procurement code on the protection of exclusive rights since all our models are deposited at the the French Patent & Trademark Office (INPI) and thus covered by intellectual property. They canent therefore be achetés as part of an over-the-counter procedure, excluding calls for tenders.
But what is article 30 of the public procurement code?
Article 30 of the public procurement code stipulates that:
“I. – Buyers can pass a negotiated public contract without advertising or prior competition in the following cases:
3° When the works, supplies or services can only be provided by a specific economic operator, for one of the following reasons:
c) Protection of exclusive rights, including intellectual property rights. "
